Is it illegal to put someone in jail without a trial?

I've seen in movies that drunk people spend the night in jail till they sober up, but any other reasons a person may be held incarcerated? It is my understanding that everyone must get a fair trial if suspected of a crime, and the burden of proof is on the accuser(s). So, is it legal to put someone in jail before you have a trial?
